As of July 31, 2026, Texas DSHS enforces reinstated 2021 controlled-substance definitions that make delta-8, delta-10, THCP, and other non-delta-9 THC isomers Schedule I — banned to sell and to possess, with possession charged as a state jail felony in some jurisdictions. Hemp-derived delta-9 products at or under 0.3% delta-9 by dry weight (gummies, edibles, beverages, tinctures) and CBD remain legal, and TCUP medical access is unaffected. Hemp vapes have been banned since September 2025 (SB 2024). Smokable THCA flower is contested: a separate total-THC testing rule effective March 31, 2026 counts THCA at 88% conversion and is in force but on appeal, so THCA flower carries real legal risk.
